California Consumer Watchdog Groups complain that funeral homes across the Southland continually ignore regulations relative to price transparency. The only state with such code restrictions, California requires funeral directors to provide written prices for goods and services. Called Funeral Home Price Transparency, California legislation [Article 5.5 (7685 – 7685.6)] stipulates the following:

“Every funeral director shall provide to any person, upon beginning discussion of prices or of the funeral goods and services offered, a written or printed list containing, but not necessarily limited to, the price for professional services offered, that may include the funeral director’s services, the preparation of the body, the use of facilities, and the use of automotive equipment. All services included in this price or prices shall be enumerated. The funeral director shall also provide a statement on that list. It should give the price range for all caskets offered for sale.”
Why Price Lists Make Sense
For reasons we don’t understand, unscrupulous funeral vendors abound. Many seek to generate as much money as possible from every transaction. To do so, they play shell games with clients. They cloak their prices in industry speak, in an effort to make customers feel embarrassed to ask pointed financial questions. This is troubling since, in the midst of dealing with grief, even typically price-conscious consumers often abandon comparison shopping. Dishonest mortician behavior is so common, it is the reason California lawmakers felt compelled to come to the aid of consumers.
The Funeral Consumer Alliance published a 2019 study about this type of practice: An Evaluation of California Funeral Home Price Disclosure and Lack of Disclosure. They discovered that, despite regulations, one-third of California funeral websites failed to meet even the most basic guidelines relative to price disclosure.
